GENERAL

The terms and conditions and privacy policy must be confirmed before the booking is completed.

Megaclue is a so-called escape game, i.e. a live exit and escape game, with a playing time of 60 minutes and is operated by BeMu have fun GmbH (hereinafter referred to as Megaclue). For children up to 16 years of age, participation is only possible when accompanied by an adult.

Megaclue undertakes to provide the service ordered and confirmed by it in writing.  Tickets cannot be exchanged for cash. The customer undertakes to pay the price agreed for the services. All descriptions and offers are subject to change without notice and in case of unavailability of the overall offer or individual elements, Megaclue shall not be obliged to compensate for the service. Should individual provisions of the General Terms and Conditions be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the remaining General Terms and Conditions shall remain unaffected.

BOOKING CONDITIONS

Booking

All persons listed in the booking must have given their authorization before booking. This can be given in writing or verbally to the responsible gamemaster on site. For underage group members, the consent of their parents or legal guardian must be presented.

The booking is made via our website www.megaclue.de. Afterwards, the booking will be confirmed again by e-mail, whereby the receipt of the booked offer is considered as confirmation. The orderer has to check the details for completeness and correctness after receipt. Errors or incompleteness have to be reported to the Megaclue team immediately, later changes are not possible.

Payment and contract

Payment is possible in advance or on site. The available payment methods are listed on the website at the time of booking and are subject to change.

With the allocation of the booking number, a legally binding contract is created between Megaclue and the customer. Additional services require a special agreement and shall be recorded in writing. Cancellations and changes by the orderer can be made within the deadlines specified in the FAQ. Megaclue reserves the right to cancel bookings that have already been confirmed for internal reasons; refunds shall then be made within seven working days.

Restrictions of use

Persons with infectious and/or contagious diseases are excluded from the use of our playrooms. Persons who are under the influence of intoxicating substances, as well as persons with a tendency to faint, and persons with severe mental and physical disabilities are only permitted to use and stay in the company of a supervisor. Serious physical illnesses that pose a danger or risk when using the playgrounds must be reported. Megaclue reserves the right to refuse use.

Liability of the contracting parties

The liability of Megaclue shall only apply if intent or gross negligence is proven. The ordering party shall not be entitled to a reduction in price. This shall not affect the right of the ordering party to remedy the defect.

Claims for damages of the orderer, irrespective of the legal grounds, in particular due to breach of duties arising from the contractual obligation and from unlawful acts, shall be excluded. This shall not apply in the event of mandatory liability. The claim for damages due to essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence or liability for injury to life, body or health. This does not imply a change in the burden of proof to the disadvantage of the customer.

Personal items brought along are located in the play and recreation rooms at the risk of the customer. Megaclue does not assume any liability for loss or damage.

Megaclue shall not be liable for damages that are due to force majeure. Computer viruses or intentional attacks on the EDP systems shall also be considered as force majeure.

The orderer, namely named in the order, shall be liable for all damage to buildings or inventory caused by him or third parties from his area.

Recording and arrival

The game rooms are video-monitored by the Gamemaster for security purposes and for the purpose of game assistance. For advertising purposes, photos and video recordings are taken of individual players. By making a corresponding note on the waiver, the customer agrees to this.

Travel to the venue is the sole responsibility of the customer.

The orderer has to arrive punctually at the booked time and has to take into account delays due to traffic, public transport and other factors. Delays of 15 minutes or more will lead to a reduction of the playing time, from the original 60 minutes by the delayed time. There is no right to a refund of the agreed remuneration.
